User Service Agreement
1. Parties to the Agreement and Scope of Application
1.1 Parties to the Agreement
This User Agreement (hereinafter referred to as “this Agreement”) is entered into between Beneficial Sino-Pass Immigration Services (Zhejiang) Co., Ltd. (hereinafter referred to as the “Operator”, with registered address / principal business address: 33rd Floor, Tower 2, Zhejiang Fortune Financial Center, No. 33 Jiefang East Road, Shangcheng District, Hangzhou City, Zhejiang Province) and users of the Beneficial Sino-Pass APP (hereinafter referred to as the “Platform”) in relation to visa products and services provided by the Operator (hereinafter referred to as the “Services”).
Careful Reading: Before signing this Agreement or using the Services, you shall carefully read and fully understand all provisions hereof, especially clauses exempting or limiting our liabilities and clauses restricting your rights. If you are a minor or otherwise lack full civil capacity, please read this Agreement and decide whether to agree to it under the supervision of your legal guardian. Your clicking [Agree] to confirm this Agreement, or your use of the Services, shall constitute your acknowledgment that you have read this Agreement and agree to be bound hereby. This Agreement shall take effect formally and be legally binding between you and us. If you do not agree to any content herein or cannot clearly understand the meaning of any clause hereof, please do not proceed with any further operations. If you have any questions about this Agreement, you may contact us via customer service.
The Operator is the entity responsible for the development, operation and service provision of this APP, legally qualified to provide immigration-related services, and strictly complies with the laws, regulations and administrative rules of the Hong Kong Special Administrative Region of the People’s Republic of China (hereinafter referred to as “Hong Kong”), including but not limited to the Personal Data (Privacy) Ordinance (Cap. 486) and the Electronic Transactions Ordinance (Cap. 553).
1.2 Scope of Application
This Agreement applies to users’ downloading, installation, registration, login and use of all services provided by this APP, including but not limited to immigration information inquiry, visa / endorsement application and appointment, immigration record inquiry, document status inquiry, emergency assistance, online consultation, etc. (collectively referred to as “APP Services”).
A user’s downloading, installation, registration, login to this APP or use of any APP Service shall be deemed that the user has fully read, understood and voluntarily accepted all terms of this Agreement, including the appendices hereto and any supplementary rules, privacy policies and other relevant documents subsequently issued by the Operator (if any), and has established a legally valid service contract relationship with the Operator. If a user does not agree to any terms herein, the user shall immediately cease downloading, installing, registering for and using this APP and related services.
2. Basic Rights and Obligations of Users
2.1 User Rights
2.1.1 Users shall have the right to normally use various services provided by this APP in compliance with this Agreement and relevant Hong Kong laws, and put forward reasonable suggestions and complaints regarding service quality.
2.1.2 Users shall have the right to inquire, correct and supplement their personal information retained on this APP, and apply for the deletion of personal information or cancellation of APP accounts in accordance with the Privacy Policy (see relevant provisions of the Privacy Policy).
2.1.3 Users shall have the right to be informed of the functions, usage rules, fee standards (if any) and relevant legal basis of APP Services, and the Operator shall explicitly notify users thereof.
2.1.4 If users’ legitimate rights and interests are damaged due to the Operator’s breach of this Agreement or relevant Hong Kong laws, users shall have the right to claim corresponding compensation from the Operator.
2.2 User Obligations
2.2.1 Users shall ensure that their personal identity information is true, accurate and complete; the Hong Kong identity card, passport and other immigration-related document information provided upon registration shall be legal and valid. Users shall not register for or use APP Services by impersonating or misappropriating others’ identity information, nor provide false or forged documents or information.
2.2.2 Users shall strictly abide by relevant Hong Kong laws and regulations and this Agreement, and shall not use this APP to engage in any illegal or irregular activities, including but not limited to forging or altering immigration documents, submitting false visa / endorsement applications, disclosing sensitive information related to immigration administration, disseminating illegal, vulgar or harmful information, attacking or altering this APP system, or interfering with the normal operation of the APP.
2.2.3 Users shall properly keep their APP account numbers, passwords, verification codes and relevant authentication information, and shall not lend, rent or transfer their accounts to others. Users shall be fully responsible for all operations conducted under their own accounts. If any account theft, abnormal login or other circumstances are found, users shall immediately notify the Operator and take corresponding security measures.
2.2.4 Users shall cooperate with the Operator to provide necessary authentication materials and supplementary information in accordance with relevant Hong Kong laws and immigration administration requirements, and assist the Operator in completing compliance reviews.
2.2.5 Users shall not copy, disseminate, modify, reverse-engineer, decompile or otherwise infringe upon any intellectual property-related content of this APP, including source code, interface design, functional modules, etc., or infringe upon the intellectual property rights of the Operator and third parties.
2.2.6 Users acknowledge and accept that APP Services may be temporarily interrupted due to technical upgrades, system maintenance, policy adjustments and other reasons, and shall not hold the Operator liable for non-fault interruptions (except for interruptions caused by the Operator’s intentional or gross negligence).
3. APP Service Content and Specifications
3.1 Service Content
The Operator provides users with the following immigration-related services through this APP (specific service content shall be subject to actual display on the APP):
(1) Immigration information inquiry: real-time information on immigration policies, visa requirements, customs clearance procedures, port information in Hong Kong and around the world;
(2) Document-related services: including but not limited to appointment and status inquiry for application, renewal, replacement and reissuance of Hong Kong identity cards, passports, Exit-Entry Permits for Travelling to and from Hong Kong and Macao (and endorsements);
(3) Immigration record inquiry: providing users with inquiry services for their legal immigration records (subject to completion of identity verification);
(4) Online consultation and assistance: providing online consultation on immigration-related issues and guidance for emergency assistance (excluding real-time rescue services);
(5) Other compliant services: other immigration-related services added or adjusted in accordance with Hong Kong immigration administration policies and user needs.
3.2 Service Specifications
3.2.1 The Operator shall provide safe, stable and compliant APP Services in accordance with relevant Hong Kong laws and this Agreement, update immigration policy information in a timely manner, and ensure the accuracy and timeliness of service content.
3.2.2 The Operator reserves the right to modify, suspend or terminate APP service content, functional modules and usage rules due to adjustments in Hong Kong immigration administration policies, technical upgrades, service optimization and other needs, and shall notify users 7 working days in advance via APP pop-ups, notifications and other means (except in emergencies).
3.2.3 Some services provided by this APP may require users to pay relevant fees (such as document production fees, appointment service fees, etc.). The Operator shall explicitly publish fee standards, payment methods and refund rules. After voluntary payment, users shall not request refunds without just cause (except in compliance with refund rules).
3.2.4 The Operator reserves the right to supervise users’ use of APP Services. If users are found to have engaged in illegal or irregular activities or breached this Agreement, the Operator may take measures including warning, service restriction, account suspension and account cancellation. For serious violations, the Operator shall report to relevant Hong Kong law enforcement agencies in accordance with the law.
4. AI Services and Content
4.1 The platform provides AI-powered consulting, policy interpretation, visa guidance, automated replies and other related services through artificial intelligence technology. AI-generated content is for reference only and does not constitute legal advice, official opinions, visa or immigration advice. You must verify the accuracy, timeliness and legality of all information before use.
4.2 AI models may produce errors, omissions or misleading results. The platform does not warrant the completeness or accuracy of AI-generated content. You shall bear all risks arising from your reliance on such content.
4.3 You may not input illegal, false, infringing, sensitive or harmful information into the AI service, nor may you use AI services to forge documents, engage in fraud or violate applicable laws.
4.4 You grant the platform a non-exclusive license to store and process your input content for the purpose of providing and improving AI services. The platform may use anonymized data for model optimization.
5. Account Management
5.1 Account Registration
When registering an APP account, users shall provide true and valid identity information (including but not limited to Hong Kong identity card number, full name, contact information, etc.), complete identity verification, and set an account password and security verification method (such as SMS verification code, facial recognition, etc.).
Users undertake that all information provided upon registration is true, accurate and complete. If any information changes, users shall update it in the APP in a timely manner; otherwise, users shall bear the consequences arising therefrom, such as failure to use services normally and abnormal accounts.
5.2 Account Use and Safekeeping
A user account is the sole credential for users to use APP Services. Users shall properly keep their accounts and passwords, and shall not lend, rent, transfer or assign them to others. Users shall bear all losses arising from account theft or password disclosure due to improper safekeeping by users themselves, and the Operator shall not be liable for compensation.
Upon discovering account theft, abnormal login, password disclosure or other circumstances, users shall immediately freeze their accounts and change passwords through the “Account Security” function in the APP or by contacting customer service, and provide relevant authentication materials. The Operator shall assist users in handling such issues but shall not be liable for losses incurred thereby.
5.3 Account Cancellation
Users shall have the right to apply for cancellation of their APP accounts according to their own needs. Before account cancellation, users shall settle all outstanding fees (if any) and complete all service matters under the account (such as unfinished visa appointments, consultation applications, etc.).
After account cancellation, the Operator shall delete or anonymize users’ personal information in accordance with the Privacy Policy (except as required by laws and regulations to retain such information). Users shall no longer be able to log in to this APP with such accounts, nor recover relevant account data and service records.
6. Intellectual Property Rights
6.1 All intellectual property rights of this APP (including but not limited to source code, software copyright, interface design, LOGO, text content, pictures, videos, data, etc.) are owned by the Operator and protected by relevant Hong Kong laws including the Copyright Ordinance (Cap. 528) and the Trade Marks Ordinance (Cap. 559).
6.2 Users shall not, without the Operator’s written permission, arbitrarily copy, disseminate, modify, reverse-engineer, decompile, rent or sell any part of this APP, or infringe upon the Operator’s intellectual property rights.
6.3 Content generated by users during the use of APP Services (such as consultation messages, feedback and suggestions, etc.) shall be deemed as a free, non-exclusive and sub-licensable right of use granted by users to the Operator unless users explicitly reserve copyright. The Operator may use such content for legitimate purposes including APP service optimization and promotion.
7. Disclaimer
7.1 The Operator shall not be liable for any interruption, delay or unavailability of APP Services caused by force majeure (including but not limited to earthquakes, typhoons, floods, fires, wars, government policy adjustments, network outages, system failures, etc.), and users shall bear the resulting losses on their own.
7.2 Losses such as service unavailability and data loss caused by users’ own operational errors, equipment failures, network problems, third-party software interference and other reasons shall be borne by users themselves, and the Operator shall not be liable for compensation.
7.3 The Operator only provides the APP service platform and related technical support. The Operator shall not be liable for any direct or indirect losses incurred by users due to the use of APP Services (including but not limited to losses arising from visa application rejection, immigration obstruction, information disclosure, etc.), unless such losses are caused by the Operator’s intentional or gross negligence.
7.4 Users shall bear all legal liabilities and losses arising from impersonating or misappropriating others’ identity information, providing false information, violating relevant Hong Kong laws or this Agreement. The Operator reserves the right to pursue users for breach of contract and shall report serious violations to relevant Hong Kong law enforcement agencies in accordance with the law.
7.5 For any third-party websites, services or content linked to this APP (if any), their ownership and liability shall belong to such third parties. The Operator shall not be jointly or severally liable therefor. Users accessing third-party content shall abide by relevant rules and laws of such third parties on their own.
8. Modification and Termination of the Agreement
8.1 Agreement Modification
The Operator reserves the right to modify or supplement this Agreement in accordance with relevant Hong Kong laws, adjustments in immigration policies, APP service optimization and other needs. The modified Agreement shall be notified to users via APP pop-ups, notifications and other means. If users do not raise objections within 7 days from the date of receiving the notice, they shall be deemed to have accepted the modified Agreement. If users do not agree to the modified Agreement, they shall immediately cease using this APP and related services, and this Agreement shall terminate.
8.2 Agreement Termination
This Agreement shall terminate automatically under any of the following circumstances:
(1) A user voluntarily cancels their APP account;
(2) The Operator terminates services to a user in accordance with the law due to the user’s breach of this Agreement;
(3) The Operator ceases to provide APP Services (with 7 working days’ prior notice to users);
(4) This Agreement cannot be performed due to adjustments in laws and regulations.
Upon termination of the Agreement, users shall cease using this APP and related services. The Operator shall handle users’ personal information in accordance with the Privacy Policy. Both parties shall no longer enjoy the rights or assume the obligations under this Agreement (except as required by laws and regulations).
9. Liability for Breach of Agreement
9.1 If a user breaches this Agreement, the Operator reserves the right to take measures including warning, service restriction, account suspension and account cancellation. Meanwhile, the user shall compensate the Operator for all losses incurred thereby (including but not limited to attorney fees, legal costs, damages, administrative penalty fees, etc.).
9.2 If the Operator breaches this Agreement, fails to provide APP Services as agreed, or causes damage to users’ legitimate rights and interests due to its intentional or gross negligence, the Operator shall bear corresponding compensation liability (limited to users’ direct losses).
10. Dispute Resolution
10.1 The conclusion, performance, interpretation and dispute resolution of this Agreement shall be governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China.
10.2 Any dispute arising from this Agreement between both parties shall be resolved through friendly negotiation first. If negotiation fails, either party may institute legal proceedings in the District Court of Hong Kong.
11. Miscellaneous
11.1 The appendix to this Agreement (the Privacy Policy) is an integral part hereof and shall have the same legal effect as this Agreement. Acceptance of this Agreement by users shall constitute acceptance of all terms of the appendix.

11.3 This Agreement shall take effect on the date when users download, install, register for, log in to this APP or use any APP Service, and shall remain valid until the termination hereof.
